By entering the contest, the entrant consents to the use of their personal information for the purpose of administering the contest and for related publicity purposes and agrees to abide by these contest rules and decisions of the Sponsor or independent contest administrator (as applicable), which are final.

ELIGIBILITY

To be eligible to win, the entrant must be a resident of Ontario, over 19 years of age at the time of the entry and not be an employee or a member of the immediate family of, or domiciled with, an employee of the LCBO, the Alcohol and Gaming Commission of Ontario (“AGCO”), any licensees authorized by the AGCO, Andrew Peller Limited (“Sponsor”), any advertising and promotion agencies associated with the contest, any prize supplier, or any contest administrator.

CONTEST PERIOD

The contest begins at 9:00 am EDT on November 26, 2023 and closes at 11:59 pm EDT on December 30, 2023.

HOW TO PLAY AND HOW TO WIN:

There are two (2) ways to enter:

  1. Via SMS text message – Text “WINE” to 844-767-9824 to receive one (1) entry. Standard message & data rates apply; refer to your cellular pricing plan for applicable costs (if any). You will be sent a reply SMS requesting you confirm your age and agree to these contest rules. You must send an SMS message reply with “yes” to complete your entry.
  2. Without a text message – Enter online at www.ourwinecontest.com (“Contest Website”) to receive one (1) entry. To enter, complete the online entry form and press “submit”.

A maximum of one (1) entry per person per method will be accepted. If it is discovered that you attempted to enter more than once all your entries will be void.

PRIZES / APPROXIMATE RETAIL VALUES (ARV) / ODDS

One (1) Prize available to be won consisting of a two (2) night Niagara wine experience for winner of the contest and one (1) travel companion (the “Companion”) to visit three (3) Niagara wineries in Ontario (ARV $4,000.00 CAD) (the “Prize”). The Prize includes: a two (2) night stay at the Riverbend Inn in Niagara-on-the-Lake in a standard room for two (2) guests; one (1) Greatest Winery Tour at Peller Estates for two (2) guests; one (1) Trius Tour at Trius Winery for two (2) guests; one (1) Gretzky Estates Tour at Wayne Gretzky Estates for two (2) guests; one (1) table reservation for lunch at either Trius Winery Restaurant or Peller Estates Restaurant (seasonal and weather permitting) for two (2) guests; one (1) $300 Gift Card to use towards the lunch meal purchase at either Trius Winery Restaurant or Peller Estates Restaurant; one (1) $250 Gift Card to purchase wine at either Peller Estates, Trius Winery or Wayne Gretzky Estates; and shuttle transportation for the winner and the Companion, from the Riverbend Inn and to/from each estate winery. Prize does not include travel to/from the Riverbend Inn in Niagara-on-the-Lake. The winner and the Companion are responsible at their cost for all travel arrangements (except as noted herein). The winner and the Companion must travel on the identical itinerary. The winner and the Companion will be required to provide appropriate government-issued photo identification at time of travel. The winner and the Companion are solely responsible for determining and obtaining all necessary travel documents and other travel requirements. Sponsor is not responsible for changes in schedule of any element of the Prize, and Sponsor is not liable for any expenses incurred as a consequence of flight or transportation cancellation/delay.

Prize does not include travel health/medical insurance, taxes, tips, gratuities, meals (except as noted herein), service charges, hotel room service, laundry service, alcoholic beverages, merchandise, souvenirs, local and long-distance telephone calls, airport charges, or any other service or item not specifically described above. In the event the trip is delayed, cancelled or postponed for any reason outside the control of the Sponsor, Sponsor will have no further obligation, other than to award the remainder of the Prize. Trip Prize will be scheduled by Sponsor at its sole discretion, and must be redeemed by March 31, 2024. Prize will be scheduled between Monday to Friday (excludes weekends). All travel and experiences must be completed before December 31, 2024. No changes will be made to travel details once any portion of travel arrangements have been made, except at Sponsor’s sole discretion. Actual retail value of Prize may vary depending on winner’s residence and may fluctuate due to market conditions, changes in value of components, (e.g. transportation and hotel rates) and other reasons.

Unclaimed Prizes will not be awarded. No Prize substitution or cash equivalent of Prize. No Prize transfer. In order to be declared a winner, the selected entrant must have correctly answered, unassisted, the mathematical skill-testing question, to be administered at a mutually convenient time and must have signed and returned a declaration of compliance with these contest rules. In addition, selected entrant and the Companion must have signed a liability release form releasing the Sponsor, its directors, officers, employees, representatives, agents, and participating retailers from all liability of any kind in connection with the contest or occurring as a result of the Prize being awarded.

The chances of winning one of the Prizes depends upon the total number of eligible entries received. Entrants agree to abide by these Contest Rules and the decisions of the Sponsor or the independent contest administrator if applicable, which decisions are final.

The winner will be required to sign a release in a form provided by the Liquor Control Board of Ontario (“LCBO”) releasing the LCBO, its directors, officers, employees and agents from all liability of any kind in connection with the contest, or occurring as a result of the Prize being awarded.

WINNER SELECTION

The winner will be selected by random draw in Vancouver, BC on or about January 8, 2024, at 12:01 pm PST. Winner will be notified by either telephone, SMS message or email. Any costs or expenses incurred by a winner in claiming or using their Prize will be the responsibility of the winner. The Prize must be accepted on an ‘as is’ basis, and there is no substitution of Prizes under any circumstances.

CONDITIONS AND RELEASE:

By participating in the contest, the entrant releases and agrees to hold Sponsor, its directors, officers, employees, representatives, agents, and participating retailers harmless from and against any and all costs, injuries, liabilities, losses or damages of any kind, including, without limitation, property damage, death and bodily injury (whether due to negligence or otherwise), due in whole or in part, directly or indirectly, to participation in the contest or in any contest-related activity or the receipt, use or misuse of a Prize or portion thereof. Without limiting the foregoing, if transportation from the Riverbend Inn and to/from each estate winery is included in the Prize, the entrant acknowledges that same is provided by independent third parties and Sponsor, its directors, officers, employees, representatives, agents, and participating retailers shall have no responsibility for any and all costs, injuries, liabilities, losses or damages of any kind, including, without limitation, property damage, death and bodily injury (whether due to negligence or otherwise), due in whole or in part, directly or indirectly, to such transportation. If transportation from the Riverbend Inn and to/from each estate winery is not included in the Prize, the entrant acknowledges that they shall be solely responsible for all transportation arrangements, and Sponsor, its directors, officers, employees, representatives, agents, and participating retailers shall have no responsibility for any and all costs, injuries, liabilities, losses or damages of any kind, including, without limitation, property damage, death and bodily injury (whether due to negligence or otherwise), due in whole or in part, directly or indirectly, to such transportation. The entrant and the Companion shall at all times comply with applicable laws and shall under no circumstances consume alcohol and drive a motor vehicle.        

Sponsor is not responsible for (i) late, lost, delayed, not received, damaged, misdirected, incomplete or illegible entries, or (ii) failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, servers, access providers, hardware or software, whether originating with sender or recipient. The SMS text messaging method of entry is designed to work with most of the major wireless carriers in Canada, but Sponsor makes no guarantee that any particular wireless service provider will participate. If any dispute arises as to identity of any entrant, an entrant shall be considered the authorized cellular or email account holder by the cellular or internet provider. “Authorized Account Holder” is defined as the natural person who is assigned a number or email address by the service provider or as shown on the service provider’s records or the natural person authorized to use the account by an entity that is shown on service provider’s records for that account.

Sponsor reserves the right to cancel or modify the contest if, in its sole discretion, it determines that the contest is not capable of running as originally planned for any reason (such as tampering or infection by computer virus, fraud, technical failures, printing or distribution errors, or any other causes or occurrences have compromised the fairness or integrity of the contest). If, as a result of an error relating to the entry process, drawing or any other aspect of the contest, there are more potential winners of Prizes than contemplated in these contest rules, there will be a random draw amongst all eligible Prize claimants after the contest closing date to award the Prize.

The contest is subject to all applicable federal, provincial, and municipal laws.

The LCBO and AGCO are not connected or affiliated with this contest in any manner whatsoever and are not liable in any way for any matter related to this contest or the Prize.
